Tras varios meses de una intens\u00edsima actividad, estos profesionales\u00a0<strong>est\u00e1n experimentando una ralentizaci\u00f3n de las contrataciones\u00a0<\/strong>que contrasta con las constantes peticiones y encargos que les hacen los\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/tags\/temas\/despachos-abogados-7743\/\" target=\"_parent\" rel=\"noopener\">despachos de abogados<\/a>. El mercado de fichajes, describen,\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/juridico\/2021-06-08\/diez-razones-arde-el-mercado-de-fichajes-legal_3119771\/\" target=\"_parent\" rel=\"noopener\">sigue m\u00e1s din\u00e1mico que nunca<\/a>, pero desde hace unas semanas resulta cada vez m\u00e1s complicado lograr encontrar a un candidato dispuesto a aceptar alguna de las jugosas ofertas que les hace la competencia. La explicaci\u00f3n, no obstante, es sencilla: se acerca el cierre de ejercicio para muchos bufetes\u00a0<strong>y, con \u00e9l, el bonus de final de a\u00f1o<\/strong>.<\/p>\n<p>&#8220;Pasa todos los a\u00f1os:\u00a0<strong>en esta \u00e9poca es m\u00e1s complicado convencer a los abogados de que se cambien<\/strong>&#8220;, afirma Sancho Pe\u00f1a, socio director de Page Executive, que matiza que las reticencias\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/juridico\/2022-05-31\/fichaje-abogado-estrella_3433441\/\" target=\"_parent\" rel=\"noopener\">est\u00e1n presentes sobre todo entre los profesionales que ejercen en despachos nacionales<\/a>, ya que son los que cierran su ejercicio en diciembre, mientras que los letrados de firmas anglosajonas no presentan este inconveniente al finalizar el a\u00f1o econ\u00f3mico entre mayo y abril.<\/p>\n<p>En la misma l\u00ednea se pronuncia Javier Moreno, socio director de la firma IurisTalent. &#8220;La mayor\u00eda de firmas cierran su ejercicio en diciembre y reparten bonus en enero o febrero.\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/juridico\/2022-09-13\/mercado-bufetes-contraofertas-prima-fichaje_3489326\/\" target=\"_parent\" rel=\"noopener\">Si un abogado se va antes, no lo cobra<\/a>&#8220;, indica. Es por ello por lo que muchos candidatos,\u00a0<strong>especialmente los de categor\u00eda m\u00e1s elevada, como\u00a0<em>counsels<\/em>\u00a0o socios<\/strong>, prefieren paralizar las negociaciones o, directamente, rechazar una propuesta de trabajo para no perder el extra. Y no es para menos: en los despachos de la abogac\u00eda de los negocios, este bonus supone un plus muy relevante que puede alcanzar desde los 2.000 para los j\u00faniores y\u00a0<strong>hasta los 30.000 para los perfiles m\u00e1s altos<\/strong>.<\/p>\n<h3 class=\"bodyObject bodyBlockquote\">El bonus oscila entre 2.000 \u20ac para los abogados j\u00faniores y hasta los 30.000 para los m\u00e1s s\u00e9niores<\/h3>\n<p>La cuant\u00eda la establece cada despacho, y suele ser un porcentaje sobre la remuneraci\u00f3n anual que recibe el abogado. &#8220;Puede estar entre el 10 y el 20%, aunque cada despacho lo fija libremente. Algunos lo condicionan a la facturaci\u00f3n que haya generado el socio, pero tambi\u00e9n pueden ligarlo a los ingresos finales del departamento o al total del bufete. Es muy heterog\u00e9neo&#8221;, aclara Moreno. Ahora bien, aunque sobre el papel se trate un elemento de retribuci\u00f3n variable (cuyo cobro, por tanto, no est\u00e1 asegurado), el\u00a0<em>headhunter<\/em>\u00a0afirma que este extra\u00a0<strong>se ha convertido en un factor fijo del salario al que pocos profesionales est\u00e1n dispuestos a renunciar<\/strong>.<\/p>\n<h2 class=\"bodyTitle\">Revisiones en diciembre y nuevos presupuestos<\/h2>\n<p>No obstante, este no es el \u00fanico elemento que explica la ralentizaci\u00f3n de las contrataciones en el sector jur\u00eddico. Como indica Mercedes Garc\u00eda Quintas,\u00a0<em>headhunter<\/em>\u00a0en Iterlegis, otro factor a tener en cuenta en este sentido, especialmente entre abogados con menos experiencia, son las\u00a0<strong>revisiones anuales o semestrales<\/strong>\u00a0que llevan a cabo muchas firmas a lo largo del mes de diciembre. En ellas, los socios y otros altos perfiles hacen una valoraci\u00f3n del trabajo de los letrados de escalones m\u00e1s bajos. Si el\u00a0<em>feedback<\/em>\u00a0es positivo, comenta Garc\u00eda Quintas, la firma\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/juridico\/2021-10-19\/abogados-junior-punto-mira-cazatalentos-sector-legal_3308389\/\" target=\"_parent\" rel=\"noopener\">revisa las condiciones de los profesionales que quiere retener<\/a>, mejorando, entre otras cosas, el salario. &#8220;Aunque la oferta quiz\u00e1s iguala o supera el futuro aumento de sueldo que les han anunciado,\u00a0<strong>en agradecimiento a la firma por apreciar su desempe\u00f1o en ese a\u00f1o, prefieren quedarse<\/strong>&#8220;, aclara.<\/p>\n<p>Por \u00faltimo, la profesional se\u00f1ala otro componente, y es la\u00a0<strong>menor disposici\u00f3n de los propios bufetes a realizar incorporaciones en esta \u00e9poca del a\u00f1o<\/strong>. &#8220;Estos meses suelen ser m\u00e1s tranquilos porque las firmas prefieren aprovechar el cierre del ejercicio para estudiar qu\u00e9 necesidades tienen&#8221;, relata. Confirma este extremo Javier Colilla,\u00a0<em>headhunter<\/em>\u00a0en Colding Advisors, quien certifica que los despachos prefieren\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/juridico\/2021-06-08\/diez-razones-arde-el-mercado-de-fichajes-legal_3119771\/\" target=\"_parent\" rel=\"noopener\">dejar de hacer contrataciones<\/a>\u00a0hasta que no tengan confirmado el presupuesto para el a\u00f1o que viene. &#8220;<strong>Quieren esperar, ver con qu\u00e9 partidas cuentan y constatar qu\u00e9 margen tendr\u00e1n para fichajes<\/strong>&#8220;, describe.<\/p>\n<h2 class=\"bodyTitle\"><em>Signing bonus<\/em>\u00a0y medidas paraca\u00eddas<\/h2>\n<p>A pesar de que la tendencia general sea una mayor tranquilidad en esta \u00e9poca del a\u00f1o, los cazatalentos consultados por El Confidencial insisten en que el mercado permanece bastante activo y\u00a0<strong>las ofertas est\u00e1n a la orden del d\u00eda<\/strong>. &#8220;Si hay necesidad, se ficha&#8221;, insiste Colilla. Sin embargo, las reticencias generalizadas vinculadas al cobro del bonus est\u00e1n muy presentes, lo que obliga a las firmas a ponerse especialmente imaginativas y buscar recursos que ayuden a convencer a los m\u00e1s dubitativos.<\/p>\n<p>Una de estas medidas es el\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/juridico\/2022-09-13\/mercado-bufetes-contraofertas-prima-fichaje_3489326\/\" target=\"_parent\" rel=\"noopener\"><em>signing bonus<\/em>\u00a0o prima de fichaje<\/a>. &#8220;Antes no era nada habitual, pero hemos empezado a verlo mucho este a\u00f1o&#8221;, describe Javier Moreno. Se trata de una cuant\u00eda que ofrece el bufete al abogado que quiere incorporar solo por el hecho de firmar con ellos. &#8220;<strong>B\u00e1sicamente, es un &#8216;te pago solo porque vengas<\/strong>&#8220;, resume el\u00a0<em>headhunter<\/em>, que define este extra como un sustitutivo del bonus. Lo m\u00e1s habitual es que estas primas se ofrezcan cuando el despacho tiene una urgencia puntual de contrataci\u00f3n en un departamento y est\u00e1n destinadas principalmente a perfiles con mucha experiencia (socios,\u00a0<em>counsels<\/em>\u00a0o asociados s\u00e9niores).<\/p>\n<p>Entre los j\u00f3venes, sin embargo, no es habitual ver los\u00a0<em>signing bonus<\/em>,\u00a0<a href=\"https:\/\/12ft.io\/proxy?ref=&amp;q=https:\/\/www.elconfidencial.com\/juridico\/2021-10-19\/abogados-junior-punto-mira-cazatalentos-sector-legal_3308389\/\" target=\"_parent\" rel=\"noopener\">pero ello no quiere decir que no se produzcan<\/a>. &#8220;Muchos despachos s\u00ed est\u00e1n dispuestos a cubrir el extra de fin de a\u00f1o o parte de \u00e9l a los abogados m\u00e1s j\u00faniores&#8221;, declara Luis del Castillo,\u00a0<em>headhunter<\/em>\u00a0en Colding Advisors, que enmarca esta postura en la encarnizada guerra por el talento que viven los bufetes. No obstante, los m\u00e1s noveles no son conscientes de ello y rechazan ofertas sin llegar a negociar este extremo. El sentir general, expone, es que el despacho que les tantea\u00a0<strong>no les va a ofrecer ese incentivo que reemplace el bonus<\/strong>. &#8220;Asumen que no lo van a poner sobre la mesa y descartan negociar&#8221;, comenta.<\/p>\n<p>M\u00e1s all\u00e1 de las primas de fichaje, Sancho Pe\u00f1a se\u00f1ala otro elemento al que est\u00e1n recurriendo las firmas: las medidas\u00a0<em>parachute\u00a0<\/em>(en ingl\u00e9s, &#8216;paraca\u00eddas&#8217;). Consiste en que el bufete\u00a0<strong>se compromete a abonar la retribuci\u00f3n pactada durante un tiempo determinado<\/strong>, a pesar de que el abogado no acabe por encajar y sea expulsado de la organizaci\u00f3n. &#8220;Suele ser progresivo: si el letrado se va el primer a\u00f1o, recibe la retribuci\u00f3n \u00edntegra; si se va el segundo, el 75%; el tercer a\u00f1o, el 50%&#8221;, ejemplifica.
